Understanding Your Rights and Responsibilities

All users of Tarika Tech’s services, and all customers upon signing up for Tarika Tech’s services, agree to comply with Tarika Tech’s Terms of Use (“TOU”). The spirit of the TOU is to ensure customers are using Tarika Tech’s services with due regard to the rights of other Internet users and in conformity with the requirements of Tarika Tech’s network environment. The TOU are not exhaustive, and Tarika Tech reserves the right to add, delete, or modify any provision of its TOU at any time without notice, effective upon either the posting of the modified TOU to www.tarikatech.com or notification of the modified TOU. Any complaints about a customer’s violation of the TOU should be sent to [email protected]The TOU supersedes any other agreement with Tarika Tech, whether written, oral, by conduct, or otherwise.
A. Tarika Tech Web Hosting & eCommerce Customer Restrictions
The following Terms of Use apply only to Tarika Tech’s Web Hosting and eCommerce customers and supplement the terms in sections C and D that apply to all Tarika Tech customers:
Server Resource Usage
To ensure optimal performance and reliability for all users, websites that place excessive demand on server resources—including CPU, memory, or bandwidth—may be required to reduce usage, optimize performance, or consider alternative hosting solutions such as dedicated environments. Tarika Tech retains sole discretion in determining what constitutes high resource usage. Web Hosting and eCommerce plans also include a file limit per account; exceeding this limit may result in account review and adjustment recommendations. Accounts that adversely impact server or network stability may be suspended without prior notice.
Unsolicited Messaging (Spamming)
The transmission of unsolicited bulk or commercial messages via the internet (“spamming”) is strictly prohibited. This includes, but is not limited to, sending spam through third-party networks while referencing sites hosted with Tarika Tech, maintaining open SMTP relays, or distributing software that enables spamming. Violations of this policy may result in immediate suspension of services and the imposition of a fine, the amount of which will be determined based on the severity of the violation.
CGI Scripts
Any scripts that pose a potential security risk or are deemed to be adversely affecting server performance or network integrity will be shut down or will be automatically removed without prior notice. Tarika Tech does not permit CGI script sharing with domains not hosted by Tarika Tech or any scripts that may be abused for UCE purposes.
Chat Rooms
Tarika Tech does not allow Web Hosting and eCommerce customers to install their own chat rooms. Chat rooms tend to require significant system resources and therefore cannot be permitted as an account option. However, Tarika Tech can provide chat rooms that meet most users’ needs and run without hindering system performance at a small charge.
Background Running Programs and Cron Jobs
Tarika Tech may allow programs to run in the background. These programs will be considered on an individual basis, and Web Hosting and eCommerce customers will incur extra charges based on system resources used and operational maintenance needed. IRC
Tarika Tech does not allow IRC or IRC bots to be operated by Web Hosting and eCommerce customers.
Software Distribution
Tarika Tech’s Web Hosting and eCommerce accounts are not configured for the purposes of distributing software and/or multimedia products. If you wish to distribute software and/or multimedia files, please contact [email protected] to make special arrangements.
Multimedia Files
Multimedia files are defined as any graphics, audio, and video files. Tarika Tech Web Hosting and eCommerce accounts are not to be used for the purposes of distributing and storing unusual amounts of multimedia files. Any Web site whose disk space usage for storing multimedia files exceeds 70% of its total usage, in terms of total size or number of files, will be considered to be using an unusual amount of multimedia files.
Databases
Any database stored on Tarika Tech’s Web Hosting and eCommerce servers will be limited in size to 10% of the total disk space allotted for that particular domain’s plan/web hosting account.
B. Tarika Tech Dedicated Server Customer Restrictions
The following Terms of Use apply only to Tarika Tech’s Dedicated Server customers and supplement the terms in sections C and D that apply to all Tarika Tech customers:
Customer Security Responsibilities
The customer is solely responsible for any breaches of security affecting servers under customer control. If a customer’s server is involved in an attack on another server or system, it will be shut down, and an immediate investigation will be launched to determine the cause/source of the attack. In such an event, the customer is responsible for the cost to rectify any damage done to the customer’s server and any other requirement affected by the security breach.
IRC
Tarika Tech allows Dedicated Server customers the use of IRC inside the Tarika Tech network as long as the use of IRC on a Tarika Tech server does not violate any of the other terms of these TOU. As a policy, Tarika Tech will not provide vanity IRC reverse DNS records. To enforce this policy, Tarika Tech does not turn the reverse address of IPs over to the customer. Authority over this information remains with Tarika Tech.
Billing for Network Resources
The customer understands that the customer is responsible for paying for any network resources that are used to connect the customer’s server to the Internet. The customer may request that the customer’s server be disconnected from the Internet, but the customer will still be responsible for paying for any network resources used up to the point of suspension or cancellation.
C. All Tarika Tech Customer Terms of Use
The following Terms of Use apply to ALL Tarika Tech customers: Tarika Tech Services Tarika Tech’s services include, but are not limited to:
Adult Content
Tarika Tech strictly prohibits the hosting of pornography or sex-related content on its servers. This includes any websites that contain, suggest, or link to adult material. In addition, any content that promotes illegal activities or could potentially harm server integrity—ours or that of others—will not be tolerated, including links to such content.
Child Sexual Abuse Material (CSAM)
The use of Tarika Tech’s services to store, distribute, display, or transmit any form of child sexual abuse material (commonly referred to as child pornography) is strictly forbidden. Tarika Tech complies fully with all applicable laws and will report any such content or activity to the appropriate law enforcement authorities immediately upon discovery.
Privacy
Tarika Tech respects the privacy of online communications and hosted content. However, customers should be aware that no method of transmission over the Internet—whether via email, web, or other protocols—is completely secure or immune from interception. While Tarika Tech implements reasonable safeguards, it does not guarantee the confidentiality or integrity of data transmitted through its infrastructure. Users are strongly advised to exercise discretion and adopt appropriate security measures when transmitting sensitive information.

Customer Responsibility
Customers are expected to use Tarika Tech’s network and services in a responsible and respectful manner. This includes avoiding any activity that may negatively impact other customers or the overall performance and integrity of the network.
While Tarika Tech does not routinely monitor customer content or communications, it reserves the right to investigate potential violations of its Terms of Use (TOU) or related policies. Upon becoming aware of any such violation, Tarika Tech may take appropriate corrective measures, which may include—but are not limited to—suspension or termination of service, restriction of access to specific systems or resources, or other actions deemed necessary to protect its network and users.
In cases involving resellers or customers providing services to others, Tarika Tech may take action in response to the activities of downstream users. All customers are expected to cooperate fully with any investigation or mitigation efforts initiated by Tarika Tech. Failure to do so constitutes a violation of policy and may result in additional enforcement actions, including those that may affect connected or third-party services.
Actions Taken by Tarika Tech
Failure to comply with these Terms of Use (TOU) may result in the suspension or termination of services. Tarika Tech retains sole discretion in determining what constitutes a violation of its policies. It reserves the right to remove, suspend, or deactivate any account without prior notice and to refuse service to any individual or entity at any time.
Upon identifying a potential violation, Tarika Tech may initiate an investigation and, during this period, temporarily restrict access to prevent further unauthorized activity. Based on the findings and severity of the issue, Tarika Tech may, at its sole discretion, restrict, suspend, or permanently terminate service, and pursue legal or equitable remedies as deemed necessary. In instances where criminal activity is suspected, Tarika Tech will report the matter to the appropriate law enforcement agencies.
Unlisted or unconventional activities may also be considered violations if they are deemed illegal, irresponsible, or disruptive to network operations. Service interruptions resulting from enforcement actions do not qualify for service credits. Furthermore, customers are fully liable for all costs incurred by Tarika Tech in resolving policy violations—including, without limitation, labor, system recovery, and responses to third-party complaints.
Indemnification
Customers agree to indemnify, defend, and hold harmless Tarika Tech and its affiliates—including officers, directors, employees, agents, contractors, consultants, subsidiaries, and third-party vendors—from and against any and all claims, liabilities, damages, losses, expenses, and costs (including legal fees) arising from the customer’s use or misuse of Tarika Tech’s services, violation of the TOU, or infringement of any third-party rights.
Disclaimer of Warranties
All services provided by Tarika Tech are offered on an “as is” and “as available” basis, without any warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Tarika Tech makes no guarantees regarding the security, reliability, availability, or performance of its services.
No oral or written information, advice, or assurances provided by Tarika Tech or its representatives shall be deemed to create a warranty. To the fullest extent permitted by law, Tarika Tech and its partners, suppliers, and affiliates shall not be held liable for any direct or indirect damages, costs, or losses resulting from use of, or inability to use, the services provided.
Termination for Bankruptcy or Insolvency
In the event that a customer becomes insolvent or is subject to any bankruptcy filing—whether filed by or against the customer—Tarika Tech reserves the right to immediately terminate all services without prior notice or liability. The customer consents to the automatic lifting of any stay of proceedings, to the extent permitted by law, allowing Tarika Tech to enforce its rights under this agreement.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, TARIKA TECH AND ITS AFFILIATES—including, without limitation, officers, directors, employees, agents, contractors, licensors, vendors, and subsidiaries—SHALL NOT BE LIABLE UNDER ANY LEGAL THEORY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE SERVICES, EVEN IF TARIKA TECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TARIKA TECH’S TOTAL AGGREGATE LIABILITY, IF ANY, FOR ALL CLAIMS ARISING OUT OF OR RELATED TO ITS SERVICES OR THIS AGREEMENT, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE SERVICES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM OR INCIDENT GIVING RISE TO SUCH LIABILITY.
Modifications to Services
Tarika Tech reserves the right to upgrade, modify, replace, or discontinue any aspect of its services, software, or systems at any time, without prior notice. These changes may affect customer configurations or custom applications. Tarika Tech bears no responsibility for any resulting impact on customer systems or content unless otherwise agreed in writing.
Data Backup Responsibility
Unless explicitly stated in a separate written agreement, customers are solely responsible for managing and backing up all data stored or processed using Tarika Tech’s services. This includes applying updates, patches, and security measures to software used in conjunction with those services.
Third-Party Licenses and Technologies
Some technologies or components provided by Tarika Tech may be licensed from or co-branded with third-party providers. Tarika Tech makes no warranties—express or implied—regarding the quality, accuracy, or continued availability of these third-party technologies. Customers use such technologies at their own risk, and Tarika Tech disclaims all liability related to the termination or alteration of such licenses.
Non-Tarika Tech Products
Any reference to third-party (non-Tarika Tech) products or services by Tarika Tech or its representatives is for informational purposes only and does not constitute an endorsement. Tarika Tech assumes no responsibility for the performance, warranties, or claims made by those third parties.
Intellectual Property
All content, trademarks, service marks, and proprietary materials on Tarika Tech’s website are the exclusive property of Tarika Tech or its licensors. Customers may not copy, reproduce, republish, distribute, or use any such material without prior written consent. Misrepresentation of affiliation with Tarika Tech is strictly prohibited.
Assignment
Customers may not assign, transfer, or delegate their rights or obligations under this agreement, in whole or in part, without prior written consent from Tarika Tech. Any unauthorized assignment shall be null and void.
Minimum Age Requirement
Use of Tarika Tech services is limited to individuals 18 years of age or older. If a minor (under 18) seeks access, a parent or legal guardian must accept the Terms of Use on the minor’s behalf and assumes full responsibility for the minor’s compliance, including all charges and obligations, unless otherwise agreed in writing by Tarika Tech.
Governing Law and Jurisdiction
This agreement and all related matters shall be governed by and interpreted in accordance with the laws of the State of Maryland, USA, without regard to conflict of laws principles. All disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland, and customers consent to venue and personal jurisdiction in those courts.
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Force Majeure
Tarika Tech shall not be held liable for any failure or delay in the performance of its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, labor disputes, equipment failures, embargoes, or government actions (“Force Majeure”). Tarika Tech will make reasonable efforts to minimize the effects and duration of any such disruption. Financial hardship or lack of funds will not be considered a Force Majeure event and will not relieve customers of their payment obligations.
Waiver and Amendment
No modification, waiver, or amendment to these Terms of Use shall be effective unless it is in writing and signed by an authorized representative of Tarika Tech.
Independent Contractors
Nothing in this Agreement shall be construed to create a partnership, joint venture, agency, or employment relationship between Tarika Tech and its customers. Each party shall operate as an independent contractor and may not bind the other to any obligation unless expressly authorized in writing.
Construction and Interpretation
Terms used in any gender shall include all genders; singular terms shall include the plural, and vice versa, where the context so requires. Section headings are provided for convenience only and do not affect interpretation. Any ambiguity shall not be construed against the drafting party.
Entire Agreement
These Terms of Use and any other applicable agreements constitute the complete and exclusive agreement between Tarika Tech and the customer, superseding all prior or contemporaneous communications, proposals, or agreements, whether oral, written, or implied. No third party shall have any rights under this Agreement unless expressly stated otherwise.
Billing Policy
Payments
All charges are in U.S. Dollars (USD). Accepted payment methods include:
Customers who provide credit card details authorize automatic billing for all applicable charges. Recurring charges will continue unless the account is properly canceled per this policy. Credit card information must be kept up to date. Non-credit card customers must remit payment within 10 days of their account statement date.
Accounts more than 30 days overdue are subject to automatic suspension. Tarika Tech reserves the right to initiate collection proceedings, with all associated legal and recovery costs payable by the customer.

Account Renewals
All hosting plans renew automatically at the end of their billing cycle at the then-current rate unless cancellation is requested per this policy. Customers must specify whether to cancel the hosting account, domain registration, or both. Expiration of a domain does not cancel the hosting plan, and vice versa.

Tarika Tech does not issue paper invoices. Statements can be requested by emailing [email protected]. 
Fees and Charges

Fee Policy Notice
All fees, charges, and billing terms are subject to change at Tarika Tech’s sole discretion. Any such changes will be communicated through official channels, including customer invoices, the billing portal, or email notification. Continued use of services after notice constitutes acceptance of the updated terms.
Returned Payments (NSF Checks)
Returned or rejected payments, including checks or other payment forms that are not honored due to insufficient funds or related issues, are subject to a standard $35.00 processing fee. Additional administrative or recovery fees may apply in cases of repeated or complex payment failures. Such fees will be evaluated and assessed on a case-by-case basis, and Tarika Tech reserves the right to adjust charges to reflect the actual costs incurred.
Wire Transfers
Tarika Tech does not charge a fee for receiving domestic or international wire transfers. However, intermediary or issuing banks may assess processing fees, which are the sole responsibility of the customer. Customers should account for any applicable bank fees when submitting payments to ensure their account is credited for the intended amount.
Account Reactivation
If an account is suspended or closed due to non-payment, policy violations, or customer request, a reactivation fee will apply. In cases where restoration of account data, configurations, or backups is required, additional restoration fees may be assessed based on the complexity and volume of the data recovery.
Hosting Plan Downgrades
Requests to downgrade to a lower-tier hosting plan may be subject to a one-time administrative processing fee. Downgrades will only be processed after all outstanding balances are settled and may require a new service agreement.
Platform Changes
Customers electing to change their hosting environment (e.g., migrating between Linux and Windows platforms) may be subject to a platform migration fee to cover administrative and technical adjustments necessary for the transition.
Hosting Plan Upgrades
Customers upgrading to a higher-tier hosting plan will not be charged an administrative processing fee. However, any differences in setup fees, configuration requirements, or prorated service charges associated with the upgraded plan will apply.
Additional Charges

Tarika Tech reserves the right to assess additional fees for custom services, non-standard configurations, advanced technical support, or special requests not explicitly outlined above. Any such charges will be communicated to the customer in advance whenever possible.

Bank Wire Payments
Tarika Tech does NOT charge fees for accepting payment via bank wire; however, international wire transfers may be assessed a processing fee by an intermediary bank, which is payable by the customer. In addition, your issuing bank may also charge a fee for sending the wire. Please add these fees to the amount that you are sending to Tarika Tech, or the amount credited to your account will be less than your intended payment.
Reactivation
Customers that wish to reactivate a closed account will be assessed $9.60 reactivation fee. $28.59 fee will be assessed if Tarika Tech restores your data files to your reactivated account.
Hosting Plan Upgrades
Customers upgrading to a higher-tier hosting plan will not be charged an administrative processing fee. However, any differences in setup fees, configuration requirements, or prorated service charges associated with the upgraded plan will apply.
Additional Charges
Tarika Tech reserves the right to assess additional fees for custom services, non-standard configurations, advanced technical support, or special requests not explicitly outlined above. Any such charges will be communicated to the customer in advance whenever possible.
Cancellations
Hosting services automatically renew unless canceled. Customers must request cancellation by contacting [email protected]. A minimum of 30 days’ notice prior to the billing renewal date is required. Cancellations requested after this window may result in another billing cycle charge.
Cancellations are processed upon receipt and do not take effect on future dates. Confirmation will be sent via email. If you do not receive confirmation, follow up immediately. Cancellations do not relieve the customer of any outstanding balance.
Tarika Tech reserves the right to cancel any account at any time, with or without notice, at its sole discretion.
30-Day Money Back Guarantee
Each of Tarika Tech’s shared hosting plans carries a 30-day unconditional money-back guarantee. If you are not completely satisfied with our services or support within the first 30 days, you will be given a full refund of the fees paid in advance (excluding setup fees) upon plan cancellation. The following services do not qualify for the 30-Day Money Back Guarantee: additional items and services; domain name registration; dedicated servers; items and services ordered through the reseller program; domain parking plus; and overage fees.
